RESPONSIBILITIES

Highland adventure, tour operator, acts only as a broker for passengers. Its function is to arrange services that airlines, bus operators, train operators, transport operators in general, hotels, tour operators and / or any other independent firm. Highland adventure, has no control over these companies, so that all travel arrangements our agency acting for and on behalf of our customers, organizing on their behalf transportation, accommodation or other required tourist services, so we don’t assume liability in case of accidents, loss, damage, delay, inconvenience or any other irregularity that may be caused by defects of any vehicle, or through situations of omission, neglect or negligence of any company or person engaged by the same, to fulfill or perform any service or part of tourist services offered, as a result of vandalism, strikes, war, governmental actions, weather conditions, or other factors which imply additional expenses caused by delays, itinerary changes or other causes. Highland adventure reserves the right to accept or reject any application for reservation of any passenger, any tour or package tour or to cancel or change a tour package, if circumstances so warrant. The application of any requested service to our company will be understood as a consent to these conditions.

PRICES & RATES

All prices and rates are in US dollars. Prices and rates of tourist packages are per person, and includes services, transfers, excursions indicated, specialized guides and entrance fees (unless different conditions specified). Rates and fees do not include extras, tips, airport taxes, airfares (unless otherwise indicated), excess baggage or any other not specified in the tour program.

ITINERARY

The itineraries are planned with great care, although, for operational reasons, it may be necessary to change the order of activities in the itinerary or the specified route, and though such cases are rare, in general the itinerary should be treated only as a basic guide. The company reserves the right to make unannounced changes to the order of the excursions or trips due to weather conditions, river levels, time of arrival or departure of aircraft, buses or trains or any other relevant reason, in order to give you the best experience.

RESERVATIONS

All reservations are subject to confirmation until full receipt of full payment or deposit for services. Payment for our services may be only be done online or in cash upon your arrival. Once the tour or package is confirmed customer by e-mail with a confirmation code, this is guaranteed, unless cancellation reasons stated under the heading of responsibilities which are totally unrelated to the company. The confirmation of the hotels are subject to availability, if there are no space, will be given another hotel of similar category and price. In regard to cancellations, returns and refunds of money these shall be governed by the terms and conditions set forth in this.

POLICIES CANCELLATION AND REFUND

Hotels or acomodation (if it is included) The client only need to appear in person at the hotel with the confirmation code and identify with his passport (in case of foreigners). Passenger shall comply with established schedules for consumption of those foods according to hotel policy. Any extra consumption is not clearly specified as included must be paid directly by the passenger and will be solely responsible for this.

Bus tickets

(if it is included in a tour package) Prices and rates of bus tickets are subject to availability and change without notice. Timetables, routes and timetables of these tickets are subject to change until the date of travel by the operator of the buses. All bus ticket reservations are subject to confirmation until full receipt of full payment for tickets. Tickets issued by way of the shuttle bus does not allow refunds, no rerouting allows and does not allow change of date. PAYMENT POLICY

Our payment policy, where individual passengers, unless different terms are specified. Any modification agreed services or hiring new services once started the trip will be paid directly by the passenger.

PAYMENT METHODS

Is through the paypal system or cash, the extra cost for the PayPal payment is included in the price.

DOCUMENTATION

The passenger is responsible for having a valid passport or other travel documents and visas according to their nationality accepted by the laws of the governments of the countries you are visiting. To make reservations will need to have the following information for each passenger: Full Name, Passport Number, Nationality, Age, Sex. Please advise allergies, diseases, conditions, passenger, characteristics of each passenger, food preferences, etc. baggage The passenger is responsible for their luggage and any claims for lost or stolen will have to do directly to the transport operator.

LIABILITIES

If a service can not be provided by an error, failure or fault attributable directly to the operator of the service, this will try to do their best to provide a solution of equal value to the service not provided. If you can not provide equivalent service not provided shall be refunded the actual price of the service excluding any consequential, indirect costs or any other costs associated with not performing this service. Any claim regarding any services not provided during the trip will only be accepted if this is done, in writing, within seven days after completion of the trip. In regard to cancellations, returns and refunds of money they will be governed by the terms and conditions set forth in the Policies Cancellation & Refund.

CANCELLATION POLICY & REFUNDS

For individual passengers and passengers in groups If a cancellation request is received until 72 hours ahead of your scheduled, return or refund will be subject to evaluation, if it is possible we will refund in full,outside the financial costs associated with the cost of bank transfer, credit card fee and any other expenses and / or costs associated with the return. Exceptions specified below.

EXCEPTIONS

No refund will be granted if the cancellation request is received to or less than 24 hours before the tour. Also, no refund will be granted for non-submission of (a) passenger (s) or cancellation during the trip. No refund for portions of tour packages unused. No return or refund will be granted in respect of these services in the event of cancellation of tour packages that include air transport services, bus and / or train already issued. In the event of termination of service of air transportation, bus and / or train already issued will not return money.

PERSONAL DATA PROTECTION POLICY

In accordance with Peruvian Law No. 29733 (Personal Data Protection Law) and its Regulations approved by Supreme Decree No. 003-2013-JUS, the user is hereby informed and provides their free, prior, express, informed, and unequivocal consent for the personal data provided through this digital platform to be incorporated into the databank owned by HIGHLAND ADVENTURE E.I.R.L., holder of RUC No. 20600985818, with fiscal domicile at Jr. Latinoamerica Nro. 190, Puno, Peru.

1. Purpose of Data Collection

The personal data requested from our clients and users (such as first and last names, ID/passport numbers, email addresses, phone numbers, and billing information) will be processed for the following purposes:

  • To manage, process, and coordinate reservations for tourist services, accommodation, transfers, guided tours, and contracted travel packages.
  • To issue the corresponding electronic payment receipts (invoices/receipts) and process payments securely through our integrated payment gateway.
  • To establish a direct communication channel to send travel confirmations, itineraries, trip updates, or security alerts related to the contracted service.
  • To address inquiries, support requests, complaints, or claims.

2. Transfer of Data to Third Parties

For the correct execution and fulfillment of the contracted tourist services, the user acknowledges and accepts that their strictly necessary personal data may be transferred to and shared with third-party strategic providers (such as hotels, airlines, local transportation operators, tour guides, partner agencies, and payment gateways), both nationally and internationally. HIGHLAND ADVENTURE E.I.R.L. guarantees that these third parties will treat your data under strict confidentiality and security measures, exclusively for the provision of the service.

3. Retention Period

The personal data provided will be stored for as long as the commercial and contractual relationship between both parties remains active, and subsequently, for the period required by current tax (SUNAT) and commercial regulations in Peru, or until the data owner revokes their consent.

4. Security Measures

HIGHLAND ADVENTURE E.I.R.L. has adopted the technical, organizational, and legal security measures required by Peruvian law to guarantee the confidentiality, integrity, and availability of personal data, preventing its alteration, loss, unauthorized processing, or access.

5. Exercise of ARCO Rights (Access, Rectification, Cancellation, and Opposition)

As the owner of your personal data, you have the right to access your information, rectify it if it is inaccurate, cancel it if you consider it is no longer necessary, or object to specific processing.

To exercise these legal rights, the user may send a formal request via email to our main platform contact address, attaching a scanned copy of their ID or Passport with the subject line: "ARCO Rights - Data Protection".

Commitment Against the Sexual Exploitation of Children and Adolescents in Tourism (ESNNA)

Highland Adventure EIRL is committed to contributing to the eradication of sexual exploitation of girls, boys and adolescents in tourism, in compliance with the Code of Conduct established by MINCETUR and Law N° 28251.

We commit to:

  • Not promoting, facilitating or tolerating any form of sexual exploitation of minors within the scope of our tourism services.
  • Training our staff to identify and report situations of risk or sexual exploitation of minors.
  • Informing our clients and suppliers about the legal penalties applicable to those who engage in such conduct in Peru.
  • Cooperating with competent authorities in any detected case.

Sexual exploitation of minors is a serious crime punishable under Peruvian law (Criminal Code, articles 173° et seq.).
